[LPN/VN, Year 5] I think there are two characteristics that reflect a person’s competence. The first trait is that a com- petent nurse is never satisfied with their level of knowledge… I feel that a second trait that highly competent nurses exhibit is confidence, or coolness under pressure… Finally I would emphasize that in an emergency situation or even just a trying situa- tion, the nurse needs to demonstrate calmness and confidence to gain the trust of the general public as well as their fellow nurses.

We've got five letters, two letters, three letters, three letters. Well, I'm a fan of the methodical approach, right? I studied math. I'm pretty into listing all the different possibilities. But, of course, here I've got 13 boxes. Each one can have up to 26 choices. So, if I took a methodical approach to this, and I wondered how long my list would have to be to try to guess this thing, well, it would be 26 to the 13th power. And for those of you who didn't just compute it in your head, it's about 2.5 quintillion.

And in that case, the argument on the defense side...well, they were actually [inaudible], but what they were arguing was that, because the board had been aware for several months of at least some of the conduct that was involved, that our window for asking for, or seeking, or imposing a summary suspension had passed. So basically, "It's de facto not an emergency because you didn't do anything about it quickly." And so, what our counter-argument was, in that case...like the initial complaint coming in March, but then, we got a subsequent complaint, much later in the year, and the summer suspension was in January.

In fact, there was plenty of evidence to support the AHCs conclusion that indeed she was using both of her credentials when she cared for the mother and the baby. Now, interesting legal aspect to this particular argument as it was presented at the Court of Appeals. Nurse Williston argued that it should have been a de novo review, that it was merely a question of law and not fact. And the Court of Appeals in a footnote kind of explained its position and said that whether a party was an agent in a given transaction is a mixed question of law and fact and that determining that mixed question was "highly dependent upon the trial court's credibility, determinations, and assessments of evidence."

Because we do know that education sometimes is not always the answer when nurses, even after passing their NCLEX, still continue to have clinical practice gaps.
